Scope
The general conditions of sale apply to all contracts of sale made between delivery JobProfile Sàrl and its Customer, the two parties accepting them without reservation. These general conditions shall prevail over any other condition contained in any document, except with prior express written consent. The general conditions of sale can be subject to changes, and the Customer is encouraged to regularly read and print them.
Purpose of the contract & contract of command
Any order implies acceptance of these terms and conditions of sale.
The services will be established by a contract specifically stating JobProfile Sàrl delivery to achieve.
Each advertisement contains no more than one job description at a time.
JobProfile Sàrl reserves the right to refuse any order that does not correspond to its jurisdiction or that could be executed to the customer's requirements. JobProfile Sàrl reserves the right to refuse any advertising contrary to its interests or contrary to good morals. This applies to links proposed by the Customer's order on elements that directly or indirectly lead to pages with illegal content. The obligation of the Customer to pay will not be affected. On first request, we will release Customer of all rights of third parties may assert against us for illegal content, or for other exceptions to the laws which the Customer is responsible. The release includes the legal costs required for prosecution.
We're providing our customers with platforms on the Internet that we operate, accessible via www.JobProfile.ch or www.JobProfile.com, and all products and services offered to recruit staff comply with our specifications. We offer our clients the following services: link on our services.
Payment Terms
Billing is based on rates prevailing on the date of the order or prices specified in the contract. Prices exclude VAT. The rates in effect are those published on the JobProfile Sàrl site or in its business documents.
JobProfile Sàrl reserves the right to change its rates.
Increases or decreases in prices are not applicable to orders currently being. The performance of an order at an agreed price does not require JobProfile Sàrl to execute a performance later on the same conditions.
Time limits and payment terms
All invoices are payable within 30 days, depending on the date of invoice, by bank transfer. In case of late payment, from the 2nd reminder, an annual interest of 5% will be charged on the total amount of the invoice.
Responsibility
JobProfile Sàrl undertakes to use every means at its disposal to ensure the best quality service possible.
However, JobProfile Sàrl cannot be held responsible for technical or telecommunications malfunctions. Similarly, JobProfile Sàrl can not be held responsible for the quality of candidates.
The subscriber agrees to use JobProfile Sàrl services respecting the privacy and rights of data protection of all individuals concerned, according to the Federal Employment Service ( LSE) Law.
JobProfile Sàrl assumes no liability for the use by its customers of the selection criteria, and in this regard cannot be blamed for any discrimination whatsoever. The user enterprise services JobProfile Sàrl is responsible for managing their personal password and using it to access his account on JobProfile LLC. Thus, when an employee in possession of the password leaves the company, or in cases of suspected misuse, JobProfile Sàrl urges the company to change the Customer password.
Royalties
This contract does not include transfer to the Client of ownership or use, licensing or software rights. All rights to use the JobProfile Sàrl software, trademarks, titles, trademarks and copyrights and other rights arising from industrial property remain in our possession. The results of all work, and all information, are published under our copyright. In these exceptions are only working results and information published by us which were developed by the Customer or third party and we've taken in the same condition for publishing on the Internet.
The Customer assumes sole and exclusive responsibility for the right of reply and correction, competitiveness and the liability for other reasons relating to the content he provided for publication. The Client will confirm the time of placing the order, he has acquired or may freely dispose of all rights of use required by the owners for publication on Internet copyright and related rights other rights to documents and data.
JobProfile Sàrl assumes no liability for misuse, of fraudulent data or data that is contrary to Swiss law, obtained through access to company subscribers.
The Client under contract with JobProfile Sàrl, using our Customer Services, certifies that advertisements placed on JobProfile Sàrl relate exclusively to filling positions for which future employees will be employed exclusively by the company releasing these advertisements.
The resale of information and services offered by JobProfile Ltd is strictly prohibited. Similarly, no benefits or information provided through JobProfile Sàrl can be transferred to another party; this includes the database of resumes and video.Any offer of employment issued by the Customer must be a real position to be filled within the company.
Contract Renewal
This contract is automatically renewed under the same conditions.
If rates or length of contract are changed, JobProfile Sàrl would submit a new offer to the client.
If the Customer does not wish to renew their contract, they must inform JobProfile Sàrl by mail (fax, email) before the due date of the contract.
Termination
Upon termination by the Customer, no refunds will be made. In addition, JobProfile Sàrl reserves the right to terminate any contract at any time without giving any reason. In this case, JobProfile Sàrl undertakes to reimburse the Client for the entire performance.
Law and Jurisdiction
JobProfile Sàrl may change these terms at any time. It is the Customer’s responsibility to check the terms and conditions in force regularly. These terms and conditions of sale are subject to Swiss law, whatever the Client's country. Any dispute regarding the interpretation of our control or relating to the execution of our services will, in the absence of agreement, settled definitively by the courts of the canton of Vaud.
All or part of this site may not be reproduced or used for commercial purposes without the written consent of Jobprofile Sàrl.
